RE: Protest Resolution for the City of Florence Ground Water Permit
Application G-15295
Dear Mr. Robinson:
To resolve the issues surrounding the ground water use permit protest
filed on behalf of Ocean Dunes Golf Links, Inc. by Steven Shropshire of
Jordan, Schrader, the City of Florence (City) proposes to meet the following
requests made by Ocean Dunes Golf Links, Inc.:

The City agrees to not file a protest again(st) Ocean Dunes
surface water appropriation permit application #S-84855.

The City agrees to not file a protest against Ocean Dunes ground
water appropriation permit application #G-15594 if the surface water permit
cannot be obtained and Ocean Dunes is required to obtain a permit to use
ground water to meet water demands. The City's understanding is that
if the surface water permit is approved that the ground water use permit
application request will be withdrawn from Oregon Department of Water Resources.
The City will include a representative from Ocean Dunes as one of the
stakeholders during development of the Well head Protection Plan (Plan).
Operation of the City well field and the adjacent golf course do not present
any further restriction on land ownership beyond the current property line.
The Plan may request that Ocean Dunes evaluate rate of application of fertilizers
and weed control products if an acceptable program is not already in place.
It is our understanding that by stating and agreeing to the above conditions,
Ocean Dunes will remove the protest against the City's ground water use
permit application in a timely manner. The City Of Florence looks
forward to maintaining a positive working relationship with Ocean Dunes
while sharing the same water resource.
