    Public Records Requests

    Oregon has a number of laws about what kind of information is "public" and what is not. For example, in general, most of the documents contained in files at City Hall are "public", with certain limited exceptions. If you need more detailed information, check out the Oregon Revised Statutes, Chapter 192 at the Library or on-line at http://landru.leg.state.or.us/ors/

    If, for some reason, a government agency (city, county, state or otherwise) refuses to give you information you believe should be open to public inspection, the Statutes provide for intervention by either the State Attorney General or Lane County District Attorney.  In Lane County, you would send the following "petition" form to: Lane County District Attorney, 125 East 8th Avenue, Room 400, Eugene, Oregon 97401-2926.  

    ORS 192.470 (2)  provides: "Promptly upon receipt of such a petition, the Attorney General or district attorney shall notify the public body involved. The public body shall thereupon transmit the public record disclosure of which is sought, or a copy, to the Attorney General, together with a statement of its reasons for believing that the public record should not be disclosed. In an appropriate case, with the consent of the Attorney General, the public body may instead disclose the nature or substance of the public record to the Attorney General."

     This form is contained in Oregon Revised Statutes 192.470:


    ORS 192.470 Petition form; procedure when petition received (1) A petition to the Attorney General or district attorney requesting the Attorney General or district attorney to order a public record to be made available for inspection or to be produced shall be in substantially the following form, or in a form containing the same information:

    (Date)

    I ___________________ (name), the undersigned, request the District Attorney of Lane County to order ___________________ (city or government agency name) and its employees to make available for inspection or produce a copy or copies of the following records:

    1. ______________________ (name or description of record)

    2. ______________________ (name or description of record)

    I asked to inspect and/or copy these records on ________ (date) at ____________ (address). The request was denied by the following person(s):

    1. ______________________ (name of public officer or employee, title or position, if known)

    2. ______________________ (name of public officer or employee, title or position, if known)
